⚠ Digital downloads only — no physical products
Flora Digital sells digital files exclusively. No print, no frame, no physical delivery of any kind. You will receive a download link by e-mail after payment. Please read these terms carefully before purchasing.
1. About Us
Flora Digital is operated by equilibric di Alberto Tacconi, Strada Regina 4a, 6832 Pedrinate, Switzerland. Contact: hello@floradigital.art. IDE/UID: CHE-309.868.911.
2. What You Are Buying
Every product in this store is a digital file — a high-resolution image in JPG or PNG format designed for personal printing. You are purchasing a licence to use that file, not a physical object. Nothing will be shipped or posted to you.
We offer three ways to buy, all one-time purchases (no subscription):
- Single artwork — buy one image.
- Gallery Wall — choose 5 artworks at a bundle price.
- Flora Pro — the entire collection (all artworks), one payment, yours forever.
Every purchase is permanent: downloads and access do not expire.
Trade-up credit: if you are logged in, the amount you have already spent on artworks in the same currency within the last 90 days is credited toward the Flora Pro price at checkout (up to, but not exceeding, the Pro price).
Flora Pro already includes the whole collection, so it is offered as an alternative — single and Gallery Wall purchases are not combined with Flora Pro, and once you own the full collection it cannot be purchased again.
The artworks are created using artificial intelligence and are digitally generated images. They are not photographs of real plants.
3. Delivery
Delivery is immediate and digital. Within a few minutes of a confirmed payment, you will receive an e-mail containing a secure download link. The link is valid for 30 days and allows up to 10 downloads. By creating a free account you can re-access your purchased files at any time from your account area.
If you do not receive the e-mail within 30 minutes, check your spam folder and then contact us at hello@floradigital.art.
Transactional e-mails (order confirmation, download links) are delivered through Brevo (formerly Sendinblue). If you subscribe to our newsletter, marketing e-mails are also sent via Brevo — you can unsubscribe at any time using the link in each e-mail.
4. Right of Withdrawal — Waiver for Digital Content
No right of withdrawal once the download begins
Under Article 16(m) of EU Directive 2011/83/EU on Consumer Rights (and equivalent Swiss law), the 14-day statutory right of withdrawal does not apply to digital content that is not supplied on a physical medium, where delivery has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.
Before completing your purchase, you are required to tick a checkbox confirming that: (a) you understand you are purchasing a digital download; (b) you expressly consent to immediate delivery; and (c) you acknowledge that by doing so you lose your right of withdrawal.
This waiver applies from the moment the download link is generated, regardless of whether you have downloaded the file.
5. Refund Policy
All sales are final. No refunds are offered.
Because digital files are delivered instantly and cannot be "returned", we are unable to offer refunds once a download link has been issued. This policy applies even if you have not yet downloaded the file.
Exceptions — technical failures only: If you experience a verifiable technical failure (e.g. the link never arrived, the file is corrupted, or the download system failed) and you contact us at hello@floradigital.art within 7 days of purchase, we will investigate and, where the fault lies with our system, provide a replacement link or a full refund at our discretion.
Refunds are not available for the following reasons:
- You changed your mind after purchase
- The file did not meet your subjective expectations
- You purchased the wrong item
- Your printer or printing service produced unsatisfactory results
- You do not have the technical means to open or print the file
6. Licence of Use
Upon purchase, we grant you a personal, non-exclusive, non-transferable, non-sublicensable licence to use the downloaded file for the following purposes only:
- Printing and displaying the artwork in your personal home or office
- Creating a small number of printed copies as personal gifts (non-commercial)
You may NOT:
- Resell, redistribute, share, or sublicense the digital file in any form
- Use the artwork for any commercial purpose (advertising, merchandise, social media accounts run for profit, etc.)
- Claim authorship or remove any copyright attribution
- Include the file in any product intended for sale (e.g. print-on-demand shops)
- Upload the file to any AI training dataset or generative AI service
7. File Specifications and Print Quality
Files are delivered in high-resolution JPG or PNG format at 300 DPI. Exact specifications (resolution, dimensions, recommended print size) are listed on each product page. Flora Digital is not responsible for the quality of prints produced by third-party printing services or home printers.
8. Intellectual Property
All artworks remain the intellectual property of Flora Digital. Purchase of a download licence does not transfer ownership, copyright, or any other intellectual property rights to the buyer.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Flora Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services. Our total liability for any claim shall not exceed the amount paid for the product in question.
10. Geographic Availability
Flora Digital sells digital products worldwide. Purchases are only restricted where we are legally unable to process them:
Purchases from countries under international sanctions (as maintained by SECO, the EU, and Stripe's compliance programme) are blocked at the payment processor level.
11. Mandatory Consumer Rights — Savings Clause
Nothing in these Terms limits or excludes any statutory rights you have under the mandatory consumer protection laws of your country of residence. Where local law grants rights that cannot be waived or excluded by contract, those rights remain fully in effect and are not affected by these Terms. In particular:
- EU / EEA consumers: Your rights under the EU Consumer Rights Directive (2011/83/EU) and the Digital Content Directive (2019/770/EU) apply. The withdrawal right waiver described in §4 is valid under Art. 16(m) where you have expressly consented to immediate delivery.
- UK consumers: Your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015 apply. The digital content waiver is valid under Regulation 37 where you have given prior express consent.
- Brazilian consumers: Article 49 of the Consumer Protection Code (Código de Defesa do Consumidor) grants a 7-day right of withdrawal for distance purchases. Brazilian case law recognises that this right may be lawfully waived for digital content once it has been substantially consumed — i.e. once you have downloaded the file — provided you were clearly informed beforehand and gave your express consent. You give that consent via the mandatory checkbox at checkout. Until you download, your 7-day right under Art. 49 remains in effect.
- Australian consumers: Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL), including statutory guarantees that digital goods be of acceptable quality and fit for purpose. If a file is defective or not as described, you are entitled to a remedy under the ACL.
12. Governing Law and Disputes
These Terms are governed by Swiss law. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, unless mandatory consumer protection laws in your country of residence provide for a different forum.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform.
13. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page indicates when they were last revised. Continued use of the site after a revision constitutes acceptance of the updated Terms.
